How long can you be held at the Wilfred Lopes Centre?


The Criminal Justice (Mental Impairment) Act 1999 allows you to be held at the Wilfred Lopes Centre for up to 4 days with the authorisation of the Chief Forensic Psychiatrist.

You cannot be held for any longer than 4 days without the authorisation of the Forensic Tribunal.

A single member of the Forensic Tribunal can authorise the detention of a person on a supervision order in the Wilfred Lopes Centre for any period that they consider is appropriate for both the treatment of the person detained and the safety of the community. 

The decision of the single member must be reviewed by the full Tribunal within a reasonable time.  The full Tribunal can continue the detention, determine that the period of detention should be altered or determine that detention is no longer required.

A person can only be detained for a period longer than four days if the Tribunal has authorised this and must only be detained for the period authorised by the Tribunal.

Return of a Person subject to a Supervision Order to the Wilfred Lopes Centre

If you are subject to a Supervision Order and it is believed on reasonable grounds that you have breached or are likely to breach the conditions of your supervision order, or there has been or is likely to be a serious deterioration in your mental condition, you can be apprehended and taken to  the Wilfred Lopes Centre, or if this is not possible, to an approved hospital pending transfer to a secure mental health unit. See section 31 of the Criminal Justice (Mental Impairment) Act 1999

Once at the Wilfred Lopes Centre you may be detained for 4 days without the authorisation of the Tribunal.  To be held any longer than four days the Tribunal must authorise this.  One member of the Tribunal can authorise your continued detention but this must be reviewed by the Full Tribunal within a reasonable time.
